Witsir Murder Mystery

(Private Parties, Performances & Entertainment Services)

 

These Terms & Conditions (“Agreement”) govern all bookings, performances, events, and services provided by Witsir Murder Mystery (“Company,” “We,” “Us”). By submitting a deposit, booking an event, or making any payment, the Client (“Client,” “You,” or “Customer”) acknowledges, understands, and agrees to the following legally binding terms.

 

 

 

1. BOOKING REQUIREMENTS

 

 

 

1.1 Reservation & Non-Refundable Deposit

 

 

A reservation is not confirmed until the required non-refundable deposit has been received.

The deposit compensates Witsir Murder Mystery for:

 

• Administrative preparation

• Reserving a specific date and time

• Turning away other bookings

• Performer scheduling and planning

 

 

All deposits are strictly non-refundable under all circumstances.

The deposit is applied toward the total cost of the event.

 

 

1.2 Balance Due

 

 

The remaining balance must be paid no later than fourteen (14) days prior to the event date.

 

Failure to pay the remaining balance by the deadline may result in:

 

• Cancellation of the performance

• Forfeiture of the deposit

• Late fees

• Release of the reserved date

 

 

 

 

2. PRICING, FEES & CHARGES

 

 

 

2.1 Performance Pricing

 

 

Pricing is based on details provided by the Client at the time of booking.

Any change to the event may affect the final cost.

 

 

2.2 Late Payment Fee

 

 

If the Client fails to pay the outstanding balance by the required due date, a late fee of ten percent (10%) per week will be assessed on the unpaid balance.

Late fees continue to accrue every seven (7) days until payment is made in full.

 

 

2.3 Change, Modification & Rescheduling Fees

 

 

Any request to modify the event—including but not limited to changes in:

 

• Time

• Date

• Venue or location

• Number of participants

• Performer or staffing requirements

• Payment schedule

• Program details

 

 

—is subject to approval by Witsir Murder Mystery and may incur additional charges of up to one hundred percent (100%) of the total event price.

 

Such charges reflect the legitimate operational costs resulting from schedule disruptions, staffing adjustments, preparation time, and administrative labor.

 

 

 

3. CLIENT RESPONSIBILITIES

 

 

 

3.1 Communication

 

 

The Client must remain responsive to communication leading up to the event.

Non-responsiveness does not waive the Client’s financial obligations.

 

 

3.2 Venue & Safety

 

 

The Client must ensure a safe, suitable environment for performers.

If safety is compromised, performers may pause or discontinue the show without refund.

 

 

3.3 Guest Conduct

 

 

The Client is responsible for ensuring all guests behave respectfully toward performers and staff.

 

 

 

4. CANCELLATION POLICY

 

 

 

4.1 Client Cancellation

 

 

If the Client cancels the event for any reason:

 

• The deposit remains non-refundable; and

• If cancellation occurs within 14 days of the event date, the full remaining balance is still due.

 

 

 

4.2 Company Cancellation

 

 

If Witsir Murder Mystery must cancel due to emergency, illness, or circumstances beyond its control, the Client may choose:

 

• A full refund of all payments except the non-refundable deposit, or

• A rescheduled event date at no additional charge

 

 

 

 

5. NON-PAYMENT & COLLECTIONS

 

 

 

5.1 After-Event Non-Payment

 

 

If Witsir Murder Mystery performs the event and the Client fails to pay the outstanding balance:

 

1. The unpaid amount becomes immediately due.

2. A 10% per week late fee continues to accrue.

3. The Client agrees to pay all reasonable collection costs, including filing fees.

4. The Company may pursue payment through:

    

   • Texas Small Claims Court

   • Collections services

   • Any legally permissible method

    

 

 

 

5.2 Returned or Disputed Payments

 

 

Returned, disputed, or reversed payments will result in:

 

• A $35 returned payment fee

• Immediate reinstatement of the balance due

• Applicable late fees

 

 

 

 

6. SERVICE LIMITATIONS & CONDITIONS

 

 

 

6.1 Force Majeure

 

 

Witsir Murder Mystery is not responsible for delays or cancellations caused by circumstances outside its control, including natural disasters, illness, emergencies, travel delays, or venue issues.

 

 

6.2 Event Start Time

 

 

Events must begin as scheduled.

Delays caused by the Client may shorten the performance without refund.

 

 

6.3 Recording & Media

 

 

Unless otherwise stated in writing, Witsir Murder Mystery may request permission to capture photos or video for promotional use.

 

 

 

7. LIABILITY

 

 

 

7.1 Client Responsibility

 

 

The Client assumes responsibility for:

 

• Venue conditions

• Guest behavior

• Compliance with venue rules

• Any property damage caused by guests

 

 

 

7.2 Limited Liability

 

 

To the fullest extent permitted by law, Witsir Murder Mystery is not liable for:

 

• Injuries caused by unsafe venue conditions

• Actions of guests or third parties

• Issues caused by venue staff or unrelated vendors

 

 

 

 

8. GOVERNING LAW & DISPUTE RESOLUTION

 

 

This Agreement is governed by the laws of the State of Texas.

 

Any dispute may be resolved through:

 

• Direct negotiation

• Mediation

• Filing in Texas Small Claims Court

 

 

Witsir Murder Mystery reserves the right to pursue legal action in any appropriate jurisdiction if the Client resides or operates outside Texas.

 

 

 

9. ACCEPTANCE OF TERMS

 

 

By:

 

• Paying the deposit,

• Making any payment toward the event, or

• Scheduling an event with Witsir Murder Mystery,

 

 

…the Client acknowledges and agrees to be legally bound by these Terms & Conditions.
